Terms & Conditions

DEFINITIONS

​

  • The “Seller” is defined as Hazel Cookes. The “Customer” means the person(s) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Customer as listed in this invoice.

GENERAL

​

  • These Terms and Conditions apply to the sale of the Goods by the Seller to the Customer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Hazel Cookes you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be revised or amended and posted on this website from time to time.

DESIGNS

​

  • These cake designs are the result of the information given to Hazel Cookes by the Customer. The interpretation of Customers’ bespoke requirements and amendments to the design, are approved by the Customer during the order process; written/verbal descriptions and a diagram will be used to explain what the Customer will receive. All rights to the design remain with Hazel Cookes.

  • We will do our best to match any colour requests for icing but we cannot guarantee an exact Pantone match as colours present differently in different materials. We aim for a perfect match but this is not always possible. 

  • All of our wedding cakes come with an ivory or white ribbon around the base board as standard unless another colour is requested. 

  • All wedding favours come with a ivory ribbon as standard unless another colour is requested.

ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

​

  • Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, however, our products are not suitable for those with allergies as our kitchen handles wheat and nuts.

  • Unless otherwise specified all our cakes contain butter, gluten (wheat) and eggs and are made in an environment that handles nuts, soya and alcohol. Nut-free, gluten-free, dairy-free and alcohol-free cakes can be made on request but we cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of production. 

  • Hazel Cookes accepts no liability for customers suffering allergic reactions from eating our cakes. 

  • It is the customer’s responsibility to make Hazel Cookes aware of any specific dietary requirements that need to be accommodated in the making of their cake. 

  • We cannot guarantee that the fruit used to make our jams and marmalades is 100% stone-free, as pips and stones can be missed in rare circumstances in the manufacturing process.

CONSULTATION AND TASTING

​

  • The samples given in the consultation and tasting are made to our existing cake recipes. However, every cake is handmade to order using fresh and natural ingredients and on rare occasions slight variations may occur as a result of this. 

  • The consultation and sampling consultation in Hazel’s kitchen is free of charge. Please note that we require 24 hours’ notice to cancel or reschedule a consultation. Failure to give this notice will result in a fee of £25. 

 

PAYMENT AND DEPOSTIS FOR WEDDING CAKES AND TIERED CAKES

  • Customers will receive written quotes with a clear breakdown of which costs apply to what aspects of the cake via the Order Confirmation and Invoice form. 

  • A deposit of 50% is required to confirm your order and save the date. Cake deposits are non-refundable. Please refer to the section regarding cancellations for more details. 

  • The final payment of the balance is due, at the latest, 14 days / 2 weeks before your event date. Payment can be made earlier if you wish, but we require the balance closed 14 days / 2 weeks prior to the agreed delivery / collection date. 

  • Failure to complete payment by 14 days / 2 weeks prior to your event date  may result in your cake order being cancelled. 

  • Payment of deposits and balances must be made through bank transfer.

ALTERATIONS

​

  • Alterations to your confirmed & ordered cake design must be requested via email to: hazelcookes@outlook.com

  • We cannot guarantee that we will be able to make alterations to cakes requested within 6 weeks of delivery. If an alteration affects the cost, your balance will be adjusted accordingly. This cost alteration must be paid 14 days prior to your collection / delivery date if the cost is over the original total. Any changes will be agreed via e-mail. 

  • Alterations to wedding favours orders may not be possible within 4 weeks of your wedding reception date.

CANCELLATION

​

  • Outstanding balance of payment for cakes remain payable if any cake is cancelled with less than 30 days notice from the event/ collection date.

  • Deposits are non-refundable. (This includes, but is not limited to, deposits for the cake, delivery and set-up, and wedding favours). 

  • Security deposits for hired equipment (eg. cake stands, knife and lights) are refundable upon the return of the cake stand to Hazel’s kitchen to the bakers satisfaction.

COLLECTION AND DELIVERY 

​

  • Hazel Cookes offers the option for customers to collect their cakes and products free of charge from our kitchen at a mutually agreed date and time. Not all cakes are suitable for collection so please ask for more detailed information. 

  • Hazel Cookes accepts no liability for self-assembly cakes that are not assembled properly or are damaged during assembly or transportation. Please note – wedding cakes can be very heavy and large and the components may come in several boxes. 

  • If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once they have left our kitchen. The cake or products can be very fragile, and we recommend that the collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Customer. 

  • We can arrange delivery to a venue of your choice at a mutually agreed date and time. A charge of £20 (or 7.5% of the cost of Goods whichever is greater) will be applicable to addresses in the following postcode areas: ME1-ME9 inclusive.  A delivery charge for venues outside of these postcode areas will be calculated and agreed on a case-by-case basis. 

  • We can also set up your cake as part of our delivery service. The charge for this will be 5% of the cost of Goods in addition to the delivery charge.

  • Where applicable, Hazel Cookes will agree a time slot of arrival for your delivery (or delivery and set-up). Protracted delays to our ability to deliver or set-up caused by customer or venue may be subject to a further charge.

  • If you wish us to deliver (or deliver and set-up) your cake or products, then the delivery / set-up details must include a suitable drop off point as agreed  with Hazel Cookes.  Hazel Cookes must receive these details 28 days’/ 4 weeks before the delivery date.  Delivery and/or set must be paid for 14 days’ / 2 weeks before the delivery date.

  • We cannot be held liable for any damages to the cake or products we have delivered once we have delivered (or delivered and set-up) the cake at the venue or delivery location, and received a signature for the safe receipt of the goods on our delivery note (we will deliver with a delivery note).

 

CAKE STAND HIRE

​

  • We offer cake stand hire. A hire fee plus a refundable security deposit is required in advance. We have a selection of stands and will provide the stand best suited to the cake. It is the Customers responsibility to return the cake stand/s after hire to our kitchen address within 4 days (on a working day). The security deposit will not be refunded in the event that the stand/s is/are damaged, or returned after 4 days.

  • Hazel Cookes are not liable for any damages that occur to the cake stand before we receive it back. Once the stand is returned within the given timeframe and we are satisfied that it is not damaged we will refund the security deposit to the Customer.

NON-EDIBLE INGREDIENTS AND DECORATIONS

​

  • Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving or eating.

DAMAGES

​

  • For cakes delivered to wedding venues, Hazel Cookes will provide a photograph as proof to say that the cake has arrived and that it arrived in perfect condition. Cakes picked up from Hazel Cookes are checked by the Customer on collection. The Buyer consents that it has been collected in perfect condition by accepting the cake and removing it from our premises. Damages after this point are not the Sellers responsibility. 

  • All wedding cakes are fragile and require care and attention when handling, storing and displaying to prevent damage occurring.  

  • Please take care when displaying your cake at your wedding reception to avoid direct sunlight, spotlights or candles creating damage to the cake decorations. Hand-painted cakes are especially vulnerable to heat and light damage. Cakes placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damaging your cake. 

  • All our cakes are designed to withstand normal and reasonable display conditions. Special requirements regarding display suitability will be discussed during the consultation process.
